TERMS AND CONDITIONS
The definitions described herein are for the purpose and use of Terms and Conditions of David Jones Real Estate.
Form 6 Refers to the document Property Occupations Act 2014.form 6
Listing agreement Refers to the document Property Occupations Act 2014.form 6
Part 8 Section 1 is in reference to part 8, section 1 of the Property Occupations Act 2014.form 6
Part 5 is in reference to part 5 of the Property Occupations Act 2014.form 6
30 Day No Lock in trial Refers to the first 30 days including the date of signing of the form 6
Contract for the purpose of these definitions means any offer from a buyer to purchase a seller’s property be it in writing or verbal.
Zero Up Front Marketing Package refers to the range services offered at no up front charge for the purpose of marketing and advertising a seller’s property for sale or rent agreed in writing by David jones Real Estate or one of its Licensed agents or agencies.
Marketing Schedule refers to the document listing the range of services available for the purpose of marketing and advertising a seller’s property for sale or rent agreed in writing by David jones Real Estate or one of its Licensed agents or agencies.
Exclusive Agreement appointment of a single agency for an agreed term not exceeding 90 days under the conditions as described in part 6 “Exclusive Agency” of the Property Occupations Act 2014.form 6
Zero Up Front Marketing Package
The services provided in the ZERO Up Front marketing package shall be decided and agreed upon at the time of signing of the form 6.
The ZERO Up Front marketing package shall be an annexure to and form part of the listing agreement.
The ZERO Up Front marketing package is offered under and bound by our terms of part 8 section 1.
The ZERO Up Front marketing package is a service provided only to sellers entering into an exclusive agreement.
30 Day No Lock In Trial
The 30 day no lock in trial shall start from and include the day signing the form 6
The 30 day no lock in trial applies to properties bound by and exclusive agreement
Under the conditions of the 30 day no lock in trial the sellers will have the right to cancel the agent’s agreement if the sellers are not satisfied with the performance of the agent provided that the sellers give the agent 48 hours to rectify the concerns of the sellers. Should the concerns be rectified the agreement will continue.
Should the sellers decide to withdraw the property under the terms of the 30 day no lock in trial the conditions under which the zero up front marketing package is offered will still be in affect.
Not Happy Don’t Pay Us
If, once the agent has found a suitable buyer, the seller is not satisfied that the agent has given satisfactory effort on behalf of the sellers, the agents fees are negotiable DOWNWARDS prior to acceptance of the offer by the sellers.
Once the offer is accepted by the sellers, the agreed fee shall be binding, with no correspondence entered into at a later time.
All fees and expenses claimed by the agent are only payable once a sale has been legally effected.
The sellers will be deemed to have accepted the price IF they sign a contract with a buyer to sell the property.
Sellers are urged to receive legal advice BEFORE signing a contract to sell the property.
